Terms of Service

1. Agreement

These Terms of Service (the "Terms") govern your use of the websites, landing pages, and forms operated by Home Maintenance Solution, located at 54 Gables Ct., Wentzville, Missouri 63385 ("HMS," "we," "us," or "our") (together, the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

The Site is intended for people who are at least 18 years old and able to enter binding agreements. By using it, you represent that you meet these requirements.

3. Our services

The Site describes our home maintenance programs, assessments, and repair services and lets you request them. Submitting a form or scheduling request does not by itself create a service agreement: the services we perform at your home are governed by the estimate, program agreement, or other written terms we provide for that work. If those terms conflict with these, they control for that work.

4. Your information

When you submit information through the Site, you agree it is accurate, current, and complete, and that you have the right to provide it. Handling of personal information is described in our Privacy Policy.

5. Calls, texts, and emails

By providing your contact information, you consent to HMS contacting you by phone, text, or email at the information provided, including through automated telephone dialing systems and AI, even if your phone number is on a state or national Do Not Call List. Consent is not a condition of purchasing any service, and message and data rates may apply. You can revoke consent at any time by replying STOP to a text, using the unsubscribe link in an email, or contacting us directly.

6. Our content

The Site and everything on it — text, guides, images, logos, video, and design — belong to HMS or its licensors. You may view and use the Site for your own personal, non-commercial purposes. You receive no other rights in our content or trademarks.

7. Acceptable use

You agree not to:

• use the Site for any unlawful purpose;
• submit false or misleading information, or impersonate anyone;
• copy, scrape, or harvest content or data from the Site with automated tools;
• interfere with the Site's operation or attempt to bypass its security; or
• use the Site in a way that restricts anyone else's use of it.

We may suspend or block access to the Site for conduct that violates these Terms.

8. Feedback and testimonials

If you send us feedback, suggestions, reviews, or testimonials, we may use them to operate and promote our business without payment or further permission, and we will only attribute them to you with your consent.

9. Third-party services

The Site links to third-party services, such as scheduling and payment tools, that we do not control. Their own terms govern your use of them, and your use of any third-party service is at your own risk.

10. No professional advice

Guides, articles, and other content on the Site are provided for general information only. They are not engineering, legal, financial, or other professional advice, and following them does not guarantee any particular result. For work on your home, rely on the written terms of the services we (or another qualified professional) perform for you.

11. Disclaimer of warranties

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, HMS disclaims all warranties about the Site, express or implied, including that it will be accurate, uninterrupted, or error-free. This section applies to the Site only; warranties for services performed at your home are stated in the written terms for that work.

12. Limitation of liability

To the fullest extent permitted by law, HMS will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Site, and our total liability arising from the Site will not exceed $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless HMS and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law rules. Before filing any claim, you agree to contact us and give us 30 days to try to resolve the dispute informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts serving St. Charles County, Missouri, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version here and revise the "Last updated" date above. Continuing to use the Site after a change takes effect means you accept the updated Terms.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign your rights under these Terms without our written consent; we may assign ours. These Terms, together with our Privacy Policy and any written service terms, are the entire agreement between you and HMS about the Site.
